Galito’s Holdings and its subsidiary companies (‘Galito’s’) provides its Websites (www.galitos.co.za, www.galitos.com and www.app.galitos.co.za; hereto referred to as the ‘Websites’) for informational purposes only. By using these ‘Websites’, you agree to follow the terms and conditions outlined in this document; should you disagree, please cease usage of the Galito’s ‘Websites’.

Site content disclaimer

While we strive to display reliable and complete content, certain errors and inaccuracies may occur within the site materials. Galito’s is not responsible for any such erroneous or insufficient content, nor are we responsible for any damage that the website may cause due to occurrences such as misstatements, omissions or viruses, amongst others. Similarly, we are not responsible for the content of or damages that may be caused by any sites that Galito’s ‘Websites’ may link to.

The materials published on these ‘Websites’ are provided for general information purposes only. While every effort is made to update the information regularly and to offer the most current, correct and accurate information, we accept no liability or responsibility whatsoever if any information is, for whatever reason, incorrect, inaccurate or dated. Orders can also be placed online via www.order.galitos.com and www.app.galitos.co.za  (the ‘Websites’), the App and Telephone Services. These terms and conditions (“Terms and Conditions”) govern the ordering, sale, delivery and collection of food, and the use of the App, online ordering and Telephone Service. These Terms and Conditions are binding and enforceable against every person that accesses or uses the App, the ‘Websites’ or Telephone Services, including without limitation each user who registers as contemplated below. By using the App, the ‘Websites’ or Telephone Services, you acknowledge that you have read and agree to be bound by these Terms and Conditions. You must not use the App, the ‘Websites’ or Telephone Services if you do not agree to the Terms and Conditions. These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act 2008. These Terms and Conditions contain provisions that appear in similar text and style to this clause and which –

  • may limit the risk or liability of Galito’s Holdings or a third party; and/or
  • may create risk or liability for the user; and/or
  • may compel the user to indemnify Galito’s Holdings or a third party; and/or
  • serve as an acknowledgement, by the user, of a fact.

App disclaimer

The Galito’s software application (the “App”) is available for download from various app restaurants on compatible electronic devices. The App enables users to order and purchase food and beverages from any of the participating Galito’s restaurants. These terms and conditions (“Terms and Conditions”) govern the ordering, sale, delivery and collection of Food, and the use of the App.  These Terms and Conditions are binding and enforceable against every person that accesses or uses the App.

Trademark disclaimer

All trademarks, trade names, logos and graphics which are a part of the Galito’s ‘Websites’, menu or any other promotional material, apart from those that form part of entities not controlled by Galito’s Holdings and its subsidiary companies, remain the exclusive property of Galito’s Holdings and its subsidiary companies. Without prior written consent from Galito’s Holdings they may not be copied, distributed, reproduced or transmitted in any form or by any means, electronic or otherwise. Access to Galito’s Stores or call centre may be suspended, temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Galito’s Holdings’ reasonable control. Galito’s disclaims all liability for any malfunction, suspension or interruption of the App, the ‘Websites’, hotline, or customer call centres, including inaccessibility due to network problems. Reasonable efforts have been made to ensure that the ‘Websites’, our server and systems are virus-free but cannot guarantee that this is the case. It is recommended that virus protection software be utilised.

Trademarks

Galito’s ‘Websites’ contain many trademarks protected under law. These trademarks are the property of Galito’s and may not be reproduced or copied without our express written permission. This also applies to the content and design of the sites.

Information submissions

Any information submitted through the ‘Websites’ to Galito’s will become and remain the property of Galito’s without any compensation to the submitter or creator. We assume no liability for the legality or copyright of the information submitted.  This includes Personal Information which, if submitted is done so consensually by the party submitting such information. Please refer to our Governing Privacy Policy (add Hyperlink) for further information in this regard.

Products and promotions

  • Certain products or promotions are only redeemable at participating Galito’s restaurants in South Africa.
  • Galito’s reserve the right to amend or stop a promotion at any time.
  • Certain offers are limited to one per customer or have a minimum order applied, per participating restaurant, within the specified period.
  • Portion weights are raw weights.
  • All visuals are suggested servings only.
  • All offers available while stocks last.
  • Prices are subject to change without prior notice.
  • All prices include VAT.
  • Should you be allergic to any food items, please request information regarding the ingredients before placing an order.
  • Some food items have traces of nuts and sesame seeds and are made using dairy products and wheat gluten.
  • All food items are prepared in the same kitchen with stringent hygiene standards.
  • Pre-packaged beverage sizes are subject to change with limited notice.
  • Galito’s Holdings will not be held responsible for a variation in marketing as a result of the supplier change.
  • E&OE
  • Whilst Galito’s holds its hygiene to the highest standard, Galito’s will not be held responsible for any illness that may occur after consuming its food products, unless there is a direct proven link between the consumption of Galito’s food and the illness thereof. 

Delivery

  • Each restaurant has a designated delivery area that is indicated on the Site for each particular restaurant in relation to where an order is placed. Only deliveries within the designated delivery area of 3km from the restaurant are accepted. If the delivery area is not specifically mentioned on the ‘Websites’ in relation to the particular restaurant that the order is placed, such area is deemed not to be included in the designated delivery area for that particular restaurant. Galito’s reserves the right not to delivery any goods to an area outside of the designated delivery area. However, Galito’s may, at its sole discretion, elect to deliver goods to area outside of the designated delivery area, subject to a reasonable delivery fee. In order to calculate the distance from the restaurant to the user for the purposes of determining whether delivery applies will be calculated as the ‘as the crow flies’ distance calculated from the restaurant ordered from, to the first point of entry (i.e. security gate). The calculation for determining the delivery will be based on the actual kilometres travelled ‘door to door’.
  • Galito’s strives for the highest quality and therefore certain menu items might not be available for delivery.
  • Orders of 10 (ten) or more meals, whether they are ordered by a single user or multiple users acting in conjunction with one another, may be excluded from delivery or certain of the delivery Terms & Conditions might not apply.
  • Delivery times may be affected due to bad weather, traffic conditions and/or any other unforeseen circumstances.
  • We will be standardising our delivery terms and conditions across all our restaurants nationally from 1 February 2019.

Cost & payments

  • All extras will be charged for.
  • All prices shown are inclusive of VAT at the standard rate.
  • Prices are subject to change without prior notice.
  • The payment choices are either cash or debit/credit card (VISA/MasterCard) for orders via the App, the Site or via the Steers contact centre.

Galito’s Holdings and its subsidiary companies (‘Galito’s’) respects the privacy of all visitors to its online sites and facilities, and we consider it important that visitors are aware of how we handle any information collected about them. Safeguarding your privacy and the security of your personal information is of utmost important to us. Please refer to our governing privacy policy found (please add hyperlink to the governing privacy policy) and take a few minutes to read it together with the following policy so that you understand how we treat your personal information. As we continuously improve and expand our services, the policies are subject to change, so please periodically for updates. If you have questions about our governing privacy policy, please contact us or our affiliates. Galito’s Holdings and its affiliates, (“Galito’s”, “we,” “our,” “us”) respects your privacy and values your trust and confidence. This privacy policy applies to the online and mobile websites (www.galitos.co.za, www.galitos.com, and www.app.galitos.co.za) (collectively the “Websites”) and the Galito’s mobile smartphone and tablet applications (the “Applications”) owned and operated by Galito’s Holdings and/or its affiliates. This governing privacy policy describes how Galito’s and/its affiliates collect and use the personal information you provide on our Websites and/or the mobile Applications. It also describes the choices available to you regarding the use of your personal information and how you can access and update this information. Galito’s recognise and value the trust that you place in us when providing us with personal information and we are committed to safeguarding the privacy and security of personal information in order to ensure compliance with the Protection of Personal Information Act 4 of 2013 as amended from time to time.

Personal information collected

Galito’s only collects personal information such as; (amongst others) your  name, contact number, email address, physical address, date of birth, and screen name. We collect this personal data when you submit a request, complete a survey, or register an account. This personal information can be submitted via our website, our online ordering platform or our social media platforms. This information is retained only by Galito’s and is used solely to provide you with direct services such as promotional offers. The information will not be sold, transferred, or disclosed to third parties.

Automatically collected information

Our web servers may automatically collect technical information that is not personally identifiable, such as your internet browser type and the pages you visit. This information is solely for aggregation purposes which we use to help improve the content of our site.

Links to other sites

Our sites may contain links to other sites and entities not controlled by Galito’s. This is for your convenience. We are not responsible for the content of these sites and suggest you review their respective distinct policies. This privacy policy is subject to change without notice. It is your responsibility to ensure you are aware of the current policy. If you do not agree with the policy, please do not use the site. Feel free to contact us if you have any questions regarding our policy.

Online advertising

Galito’s Holdings engages third parties that help us deliver our banner advertisements and other online communications. The third parties may collect and use information about Galito’s Holdings customers to help us understand the offers, promotions and types of advertising that are most appealing to our customers. The personal information they collect is aggregated and cannot be linked to a person. If you do not wish your personal information to be used in this way, please notify us.

  • Third party vendors, including but not limited to; Google and DoubleClick, show Galito’s’ ads on sites on the internet.
  • Third party vendors, including but not limited to; Google and DoubleClick, use cookies to serve ads based on a user’s prior visits to Galito’s Group’s website.
  • Users may opt out of Google and DoubleClick’s use of cookies by visiting the Google advertising opt-out page or by visiting the Network Advertising Initiative opt-out page.

Galito’s online ordering terms & conditions, privacy policy and terms of use of website

Galito’s International (Pty) Ltd, a private company registered in South Africa with registration number 2003/003045/07 and its various franchises (collectively “Galito’s” / “us” / “we”), operates fast food chicken outlets throughout South Africa and abroad, under the name and style “Galito’s”.

This document sets out the terms and conditions (“Website Terms”) on which we provide our services and offer our products through our websites www.galitos.co.za, order.galitos.com, and www.app.galitos.co.za and any other third party mobile application through which you access our websites or services (together, the ‘Websites’). Please note that this includes any current or future version of our websites, whether accessed through any current or future platform or device (including without limitation any mobile website, mobile application, affiliate website or related website for accessing our website or services that may be developed from time to time).

We use an agent, Yumbi (Pty) Ltd, reg. no. 2013/118566/07 to provide the website platform and to process the online orders. Yumbi forwards the orders to us to make delivery to you and maintains the Website. Please note that we are not responsible for any negligence, omissions or any of the consequences thereof where Yumbi is accountable.

The ‘Websites’ user (”you”) must read, and by proceeding further, agree to the ‘Websites’ Terms and Conditions carefully before using the Website or ordering any products from our Website, as your use of the ‘Websites’ and your purchase of any products offered on the ‘Websites’ is subject to these Website Terms and Conditions. By ordering products via the ‘Websites’, you agree to be bound by these Website Terms and Conditions.

We reserve the right to change these Website Terms and Conditions from time to time by changing them on this page.

Online ordering terms & conditions

  1. How to make an order and how it is processed
    • Once you have created your order from the menu of your chosen Restaurants you will be given the opportunity to submit your order by clicking on the “proceed”, “place my order” or similar button.
    • We will provide you with an opportunity (a) to review the entire electronic transaction; (b) to correct any mistakes; and (c) to withdraw from the transaction, before finally placing any order.
    • If at any time prior to you clicking on the “proceed”, “place my order” or similar button, you decide that you do not wish to proceed with your order, you should clear you order basket and then close the application window.
    • On receipt of your order, we will begin processing your order and we will send you a notification by either SMS or email when your order has been received and/or if we are unable to process or deliver it for any reason.
    • Where any payment you make is not authorised you will be returned to the previous page on the Website and we shall not be obliged to provide the goods or services.
    • Please note that once you have paid for your order and your payment has been authorised you will not be able to cancel your order nor will you be entitled to a refund except in the circumstances set out in clause 2.
  1. Price and payment
    • Prices will be as quoted on these ‘Websites’. These prices include VAT but may exclude delivery costs, which will be added to the total amount due (if you opt for delivery instead of collection), where applicable.
    • Prices are subject to change without prior notice.
    • All prices include VAT.
    • This Website contains a large number of menus, and it is always possible that some of the menus may be incorrectly priced. If the correct price for an order is different from the price stated on the Website the Restaurant will normally contact you before the order in question is dispatched.
    • Customer care is extremely important to us, therefore, if you are dissatisfied with the quality of food ordered through this Website due to it being defective in any way, we will assist you, where possible, in seeking either a replacement product or a refund, in our discretion, to a maximum amount equivalent to the value of the original order. An important part of our quality control process is that consumers provide ratings and feedback on the ‘Websites’ to reflect their experiences with restaurants. Please note that any complaint must be lodged with our customer care team within 48 hours of placing the order.
    • All transactions must be paid in South African Rands (ZAR), or the currency applicable in the country of order. Payment for all orders must be by credit or debit card as stated on this ‘Website’ or in cash at the point of collection or delivery to you.
    • A discount may apply to your order if you use a promotional code recognised by this Website and endorsed by Galito’s.
    • Please note that from time to time there may be delays with processing payments and transactions; on occasion this may result in payments taking up to sixty (60) days to be deducted from your bank account or charged to your credit card.

  • the manner of payment is by way of a secure payment method of either a debit or credit card, with details entered online or by way of cash or credit or debit card at the store when collecting the order;
  • the terms of agreement, including any guarantees, that apply to the transaction are set out in clauses 2 of these Website Terms and Conditions which may be accessed and stored electronically by you but may not be reproduced except for personal use;
  • the goods will be dispatched or delivered as set out in clause 4;
  • you can access and maintain a full record of the transaction under the “Your Account” tab on the ‘Websites’ at any time for a period of 12 months after the transaction;
  • our return, exchange and refund policy is set out in clause 2;
  • we do not subscribe to an alternative dispute resolution code;
  • our security procedures and privacy policy in respect of payment, payment information and personal information are set out below;
  • there is no minimum duration of the agreement as the transactions are ad hoc; and
  • section 44 of ECTA does not apply as the goods are perishable, consumer goods.

    • Access to Galito’s Stores or call centre may be suspended, temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Galito’s reasonable control. Galito’s disclaims all liability for any malfunction, suspension or interruption of the App, the ‘Websites’ or Customer Call Centers, including inaccessibility due to network problems. In particular, we do not promise that the information provided by the Restaurants and displayed on this Website such as the menus, pricing and estimated times for deliveries and collections is correct or up to date.
    • Galito’s provides you with access to the ‘Websites’ and our services on the basis that, to the maximum extent permitted by law, we exclude all representations, warranties, conditions and other terms (including any conditions implied by law which but for these Website Terms and Conditions might apply in relation to the ‘Websites’ and the services that we provide).
    • You are responsible for the security of your password that you used to register with the ‘Websites’. Unless Galito’s negligently discloses your password to a third party, Galito’s will not be liable for any unauthorised transaction entered into using your name and password.
    • Unfortunately, the transmission of information via the internet is not completely secure and free from viruses. Although we will take steps to protect your information, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk.
    • Galito’s, and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including any direct, indirect, punitive or consequential loss or damages, contract or otherwise, even if foreseeable) in connection with our services, the Websites or in connection with the use, inability to use or the results of use of the ‘Websites’, any websites linked to the ‘Websites’ or the material on these ‘Websites’.
    • With the exception of any liability referred to above, our total liability to you in relation to your use of the ‘Websites’ and purchase of goods from them and the services that we provide is limited to an amount equivalent to twice the value of your order or One Thousand South African Rands (R1000.00), whichever is the lower.
    • If your use of material on these ‘Websites’ results in the need for servicing, repair or correction of equipment, software or data, you assume all associated costs.
  1. Events outside our control
    • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (“Force Majeure Event”).
    • A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
      • strikes, lock-outs or other industrial action;
      • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
      • fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
      • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
      • impossibility of the use of public or private telecommunications networks; and
      • the acts, decrees, legislation, regulations or restrictions of any government.
    • Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
